§ 1 Provider, scope

(1) The provider and contractual partner for the goods and digital content presented in the online shop at https://yataoshop.com is Yatao GmbH, Heimatstraße 19, 79102 Freiburg, phone 0157 53535158, email info@yataoshop.com (hereinafter "Provider").

(2) These General Terms and Conditions form part of every contractual agreement between the Provider and the respective customer. Any conflicting terms and conditions of the customer are hereby rejected.

(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession (§ 13 of the German Civil Code (Bürgerliches Gesetzbuch, BGB)).

§ 2 Range of goods and conclusion of contract

(1) The Provider offers the goods presented in this online shop for sale. The colours of the goods as displayed on the website may vary slightly depending on the browser used and the customer's monitor settings; such deviations can never be entirely avoided for technical reasons.

(2) Handpans are handmade instruments. Sound, surface and colour may differ slightly from instrument to instrument and from the product photos. Instruments made of stainless steel and Ember Steel may develop a natural patina or change in colour over time.

(3) Selection of goods, conclusion of the contract and processing of the contract take place in German, English or French, at the customer's choice.

(4) The presentation of the goods in the online shop constitutes a binding offer by the Provider. By clicking the button "Pay now" or "Place order" at the end of the ordering process, the customer accepts the offer. The Provider confirms the conclusion of the contract without undue delay by email (order confirmation).

(5) Before the order is placed, the customer is shown an overview of the data recorded for the order, including the essential characteristics of the goods. At this point, the customer can check the data for input errors and, if necessary, go back one or more steps in the ordering process to change the data or cancel the order altogether.

(6) After conclusion of the contract, the Provider sends the customer the contract content (contract text) by email. The contract text is stored by the Provider but is no longer accessible to the customer via the internet after the order has been completed; the customer should therefore keep the email. Customers with a customer account can additionally view their orders in the customer account.

§ 3 Prices and payment

(1) For deliveries within the European Union, all prices are final prices including the statutory VAT of the respective country of delivery, plus shipping costs. For deliveries to countries outside the EU, prices are shown excluding VAT; customs duties, import VAT and fees may be incurred there, which are borne by the customer (see para. 6).

(2) Shipping costs are displayed during the ordering process before the order is placed. An overview can be found in our shipping policy.

(3) The customer may use the following payment methods: credit card (Visa, Mastercard, American Express, Maestro), PayPal, Klarna (depending on the country, e.g. invoice or instalment purchase), Shop Pay and prepayment by bank transfer. In individual countries, further payment methods (e.g. Apple Pay, Google Pay, Alma) may be offered; the available payment methods are displayed during the ordering process.

(4) In the case of payment by prepayment, the purchase price must be transferred to the account stated in the order confirmation within five bank working days of receipt of the order confirmation. The Provider reserves the goods during this period. If payment is not received on time, the Provider is entitled to withdraw from the contract and to sell the goods elsewhere.

(5) The goods delivered remain the property of the Provider until paid in full.

(6) For deliveries to countries outside the EU, customs duties, import VAT and fees may be incurred, which are levied upon import by the competent authority or the shipping carrier and are to be borne by the customer. By way of derogation, the Provider delivers handpans to the USA and the United Kingdom duties paid (DDP – "Delivered Duty Paid"); in this case, customs duties and import charges are included in the price displayed or in the shipping costs.

§ 4 Delivery, delivery time, pre-sale

(1) The delivery time is stated for each item. Unless otherwise stated, the Provider ships within 48 hours (working days) after receipt of payment; for deliveries outside the EU, shipping preparation may take up to four working days due to the customs documents. For payment via Klarna (invoice/instalment purchase), the period begins with the conclusion of the contract.

(2) Pre-sale: Instruments marked as "Pre-Sale" are still being manufactured or supplied at the time of the order. The expected shipping date or shipping period is stated in the product description and is deemed the agreed delivery time. If delivery is delayed by more than four weeks beyond the stated date, the Provider will inform the customer; the customer may then withdraw from the contract and will receive any payments already made back without undue delay.

(3) Several items ordered at the same time are generally delivered in a single shipment; in that case, the delivery time of the item with the longest delivery time applies. If the customer wishes to receive an item with a shorter delivery time in advance, the customer may order it separately.

(4) If delivery fails because the customer has provided an incorrect or incomplete delivery address, a further delivery attempt will only be made if the customer bears the direct costs of the renewed shipment.

(5) Handpans are shipped with DHL or DHL Express and are insured for at least €2,500 or up to the value of the goods. We ask the customer to report any obvious transport damage to the carrier as soon as possible and to inform us immediately with photos of the damage and the packaging. The customer's statutory rights – in particular the statutory warranty rights – remain unaffected; for consumers, the risk passes only upon handover of the goods.

§ 5 Right of withdrawal and voluntary right of return

(1) Consumers have a right of withdrawal in accordance with the instructions on withdrawal.

(2) The Provider grants consumers whose permanent residence is outside Germany a right of withdrawal under the German conditions and legal consequences even if the consumer's national law does not provide for a right of withdrawal or makes it subject to a shorter period or stricter form.

(3) In addition, the Provider grants customers with a delivery address in the European Union a voluntary right of return of a total of 30 days from receipt of the goods in accordance with the terms of the "Voluntary right of return". The statutory right of withdrawal remains unaffected.

§ 6 Statutory warranty

(1) The statutory rights in respect of defects apply.

(2) A natural detuning caused by playing and by fluctuations in temperature and humidity over a longer period of time is typical of use for handpans. For retuning, the Provider additionally offers the retuning guarantee pursuant to § 7 for YataoPan and Ayasa handpans.

§ 7 Retuning guarantee

For handpans of the brands YataoPan and Ayasa purchased in the Provider's online shop, the Provider grants a retuning guarantee of two years in accordance with the guarantee terms. The customer's statutory rights are not affected by the guarantee.

§ 8 Digital content (online courses)

(1) For digital content (e.g. online courses of the Malte Marten Method offered in the shop), the customer receives access by email or via the stated learning platform after conclusion of the contract. Use is limited to personal, non-transferable use.

§ 9 Vouchers

Gift vouchers can be redeemed in the online shop for the purchase of goods. Cash payment is excluded. Vouchers are valid for three years from the end of the year in which they were purchased.

§ 10 Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers whose habitual residence is abroad, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state of their habitual residence.

(2) Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

Guarantee terms – Retuning guarantee

1. Guarantor: Yatao GmbH, Heimatstraße 19, 79102 Freiburg, Germany, email info@yataoshop.com.

2. Scope: The guarantee applies to handpans of the brands YataoPan and Ayasa purchased in the online shop yataoshop.com. It applies worldwide.

3. Guarantee period: two years from delivery of the instrument to the first purchaser.

4. Guarantee service: If the instrument goes out of tune through normal playing within the guarantee period, we will organise the retuning and bear the costs of the retuning, the insured shipping there and back, and the transport insurance. The retuning is carried out by us or by a handpan maker commissioned by us.

5. Not covered are: damage caused by falls, impacts, pressure or other external influences (e.g. dents); damage caused by improper storage or handling (e.g. extreme heat, moisture, lack of care and corrosion caused thereby); changes resulting from interventions by third parties not commissioned by us; purely cosmetic changes such as patina or discolouration without any effect on sound and tuning.

6. Making a claim: Please contact us by email at info@yataoshop.com stating your order number and a short description (ideally with an audio or video recording). We will review the case and send you the shipping documents. Please do not ship the instrument without prior agreement.

7. Your statutory rights in respect of defects against us as the seller exist alongside this guarantee and are not restricted by it. Asserting the statutory rights is free of charge.

8. For handpans by other handpan makers (e.g. MAG, Mudra, Gio’s Instruments), the guarantee or retuning terms of the respective manufacturer apply, where available. We will be happy to assist you with processing.
